1) Who We Are & How to Reach Us

“XTIDE”, “XTIDE Clean”, “we”, “us”, or “our” refers to the operator of the website xtideclean.com (the “Website”) and the provider of cleaning services marketed on the Website.

Primary contact details published on the Website include: +61 455 212 137, xtideclean@gmail.com, and info@xtideclean.com. These may be used for general queries, bookings, or complaints.

We provide residential and commercial cleaning services across the Perth metropolitan area and listed suburbs, subject to availability.

2) Acceptance of These Terms

By using the Website, submitting a contact or quote form, or booking/receiving services from us (collectively, “Services”), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”).

If you do not accept these Terms, do not use the Website or proceed with any booking.

We may update these Terms from time to time. Changes take effect upon posting on the Website. Continued use of the Website or Services constitutes acceptance of the updated Terms.

3) Service Description & Scope

XTIDE markets a range of cleaning services that may include (as shown on the Website): commercial cleaning, office cleaning, deep cleaning, one-off cleaning, regular cleaning, and additional services (e.g., window and carpet cleaning), subject to availability and specific job assessment. The exact inclusions for any visit will be clarified in writing during booking confirmation.

Availability is limited by location, schedule capacity, site safety, and the practicality of requested tasks.

We reserve the right to refuse any job that presents safety concerns, unreasonable risk, unlawful requirements, or is outside our capabilities.

4) Quotes, Scheduling & Confirmations (No Online Payments)

Quotes/Estimates. Quotes are provided free of charge via the Get a Quote or Contact Us functionality or via phone/email. A quote is an estimate based on information provided by you and/or a site assessment. It may change if the actual scope, access, or condition differs from what was initially described.

Scheduling. A booking is considered “confirmed” only when we send written confirmation (e.g., email or SMS/WhatsApp).

No Online Payments. The Website does not accept or process online payments. Any fee arrangements are handled offline or as otherwise agreed in writing between you and XTIDE. (You have explicitly indicated there are no payment terms and no third-party processors used on the Website.)

5) Client Responsibilities

Access. Ensure we have timely, safe access to the premises for the scheduled time.

Utilities. Provide basic utilities necessary for cleaning work (e.g., electricity, running water, adequate lighting, reasonable ventilation).

Prep & Decluttering. Please remove fragile items, valuables, and excessive clutter from work areas to enable efficient and safe cleaning.

Parking. If any parking fees or special arrangements are required to access your premises, please inform us in advance and arrange accordingly.

Pets. Secure pets in a way that ensures the safety of both the pets and our staff.

Honest Information. Provide accurate information about the property condition, special surfaces, materials, or hazards (e.g., mold, biohazards, asbestos, pest infestations).

6) Health, Safety & Site Conditions

We will not undertake tasks that could reasonably endanger our staff or others (e.g., working at unsafe heights, moving extremely heavy items without proper equipment, or handling hazardous substances without proper controls).

We will not operate in areas contaminated with hazardous materials unless they have been professionally remediated.

We comply with reasonable industry safety practices. You agree to alert us to any known hazards on your premises before service begins.

7) Supplies, Equipment & Quality

XTIDE uses appropriate cleaning methods and equipment consistent with the requested service. If you require the use of specific products (e.g., hypoallergenic or eco-friendly), please request this in advance so we can confirm feasibility.

We apply a reasonable care and skill standard in delivering Services.

Make-Good / Re-Clean Window. If you believe an agreed area has been missed relative to the confirmed scope, notify us promptly (ideally within 24–48 hours of service completion) with clear details and photos where practical. If, after review, we agree the work fell short of the agreed scope, we may arrange a reasonable make-good re-visit. This remedy is at our discretion and is your sole and exclusive remedy for any service shortfall.

8) Public Liability Insurance & Police Clearance

XTIDE states on the Website that it holds Public Liability Insurance up to $20,000,000 and that its personnel maintain Police Clearance. Proof can be presented on request during quoting/engagement.

Insurance coverage is subject to policy limits, exclusions, and insurer terms and conditions.

9) Breakages, Damage & Claims

Pre-Existing Conditions. We are not responsible for pre-existing damage, wear and tear, faulty/loose fixtures, or latent defects (e.g., loose tiles, unstable shelving, worn carpet seams).

Fragile/Special Items. We do not handle high-value/fragile items, heirlooms, specialty collectibles, or items requiring specialist cleaning techniques unless explicitly agreed in writing.

Reporting. Report any alleged damage or loss as soon as reasonably practicable and no later than 48 hours after service completion, with photos and a description.

Inspection. You agree to give us a reasonable opportunity to inspect and, if applicable, repair or make good.

Limits. Our liability for proven direct damage is limited to one of the following remedies (at our option): (i) re-performance of the relevant service; (ii) supply of the service again; or (iii) payment of the cost of having the service supplied again. Indirect, incidental, special, exemplary, or consequential losses are excluded to the fullest extent permitted by law.

10) Exclusions (What We Don’t Do)

Unless explicitly agreed in writing, we do not:

Perform building/repair work, electrical or plumbing work, or any licensed trade activity.

Remove deep-seated mold requiring professional remediation; remove biohazards; or clean human/animal waste beyond normal sanitary scope.

Work above reasonable heights (e.g., second-storey exteriors without compliant equipment) or in confined spaces without appropriate controls.

Dispose of construction debris, hazardous materials, or large rubbish volumes beyond normal household waste.

Move large/heavy furniture or appliances that could cause damage or injuries without appropriate equipment and manpower.

Guarantee stain removal where stains are set, oxidized, irreversibly discolored, or where the fabric/fiber specifications are unknown or incompatible with safe treatment.

11) Website Use & Content

Informational Nature. Content on the Website is for general information and marketing purposes and may change without notice. We do not guarantee that all content is accurate, complete, or current.

Intellectual Property. The Website design, text, graphics, logos, images, and other materials are owned by or licensed to XTIDE. All rights reserved. You may not copy, reproduce, modify, distribute, or create derivative works from the Website content without prior written consent.

Prohibited Use. You must not misuse the Website (e.g., introduce viruses/malware, conduct scraping that degrades performance, spam forms, or attempt to gain unauthorized access).

Availability. We do not warrant that the Website will be error-free or available without interruption. We may suspend, withdraw, or change all or any part of the Website without notice.

12) Third-Party Links & Tools

The Website may link to third-party sites (for example, the design credit links). We are not responsible for external content or policies, and accessing third-party sites is at your own risk.

You have confirmed that the Website itself does not use third-party analytics, ad networks, or payment processors.

13) Privacy

Our handling of personal information submitted via the Website (e.g., quote forms, contact forms) is governed by our Privacy Policy, which forms part of these Terms.

In brief, the Website collects only the information you submit to contact/obtain a quote, plus minimal technical information necessary for secure operation. 14) Cancellations, No-Shows & Delays

If you need to cancel or reschedule, please notify us as early as possible so we can reallocate the slot.

If we arrive and cannot gain access, or if conditions prevent us from performing the work safely, we may leave the site and treat the visit as a no-show.

We may reschedule or cancel a booking due to events outside our control (e.g., illness, extreme weather, traffic incidents, emergencies, or supply constraints).

15) Warranties & Disclaimers (Services)

To the maximum extent permitted by law, we disclaim all implied warranties not expressly set out in these Terms.

Where the law implies warranties or guarantees that cannot be excluded, our liability is limited to the remedies described in Section 9.5 above.

16) Limitation of Liability (Website)

To the fullest extent permitted by law, XTIDE will not be liable for any indirect, incidental, special, punitive, or consequential damages, loss of profits, loss of data, business interruption, or loss arising from reliance on Website content or from Website downtime or errors.

17) Indemnity

You agree to indemnify and hold harmless XTIDE (and its personnel) from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your misuse of the Website, breach of these Terms, or violation of any law or rights of a third party.

18) Governing Law & Jurisdiction

These Terms are governed by the laws of Western Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia for any disputes arising out of or relating to these Terms or the Services.

19) Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

20) Entire Agreement

These Terms constitute the entire agreement between you and XTIDE concerning the Website and Services and supersede any prior or contemporaneous communications on the same subject matter.
